Definitions
“COMPANY” means BEPITE SAS, SIREN 910193218, registered with the Paris Trade and Companies Register and having its registered office at 14 rue Ernest Psichari, 75007 Paris, France.
“TERMS” means these Terms and Conditions of Sale.
“ORDER” means an order placed by a customer on the website.
“ACCOUNT” means the user account created by a customer on the platform.
“AGREEMENT” means the contractual agreement formed by these Terms and the Terms of Use.
“DATA” means a customer's personal data that the customer provides to BEPITE SAS.
“CUSTOMER” means any individual who makes a purchase or subscribes to a service on the COMPANY's websites.
“PRODUCT” or “SERVICE” means digital content, subscriptions, online courses, and any other item that a customer may purchase or subscribe to.
“SUBSCRIPTION” means recurring monthly or annual access to a digital PRODUCT, with or without a free trial.
“FREE TRIAL” means the limited trial period offered to the CUSTOMER before billing for a SUBSCRIPTION begins.
Article 1 - Purpose of the Agreement
These Terms define the rights and obligations of the parties in connection with the online sale of goods and services offered by BEPITE SAS on https://ecole.hellofrench.com and https://www.hellofrench.com (the “Websites”).
These Terms constitute the entire agreement between the parties regarding their contractual relationship. No additional or replacement terms proposed by the CUSTOMER will apply.
By using, purchasing, or subscribing to any PRODUCT or SERVICE offered on the Websites, the CUSTOMER confirms that they have read and fully accept these Terms.
The COMPANY may amend these Terms at any time without prior notice by publishing a new version on its Websites. The Terms in effect on the date of payment or subscription will apply.
Article 2 - User Accounts
To access the PRODUCTS and SERVICES, the CUSTOMER must create an ACCOUNT using a valid email address.
Each individual may hold only one ACCOUNT. A single person may not create multiple accounts, including by using email aliases (such as variations containing “+” or “.”) or different email addresses.
The CUSTOMER is responsible for keeping their login credentials confidential and for all activity carried out through their ACCOUNT.
If these conditions are not met, the COMPANY may merge, suspend, or delete any ACCOUNT without prior notice or compensation.
Article 3 - Subscriptions and Free Trials
A - Recurring subscriptions Some PRODUCTS are offered as monthly or annual SUBSCRIPTIONS. Unless the CUSTOMER cancels before the renewal date, the SUBSCRIPTION will automatically renew for the same term. The CUSTOMER will be charged the rate in effect at the time of renewal.
The CUSTOMER may cancel a SUBSCRIPTION at any time through their account or by contacting contact@hellofrench.com. Cancellation takes effect at the end of the current paid period. No prorated refund is issued for a period that has already begun.
Monthly SUBSCRIPTIONS do not include a FREE TRIAL or the personalized services included with the annual SUBSCRIPTION, including the private video call described in Article 8 bis. They do, however, include the 15-day money-back guarantee. The first payment is charged immediately when the CUSTOMER subscribes. These conditions are clearly displayed on the subscription page before the CUSTOMER confirms the order.
B - Free trials The COMPANY may offer a FREE TRIAL for certain SUBSCRIPTIONS, typically the annual SUBSCRIPTION. A valid payment method is required. At the end of the trial, the SUBSCRIPTION automatically converts to a paid subscription unless the CUSTOMER cancels before the trial ends.
Each individual may use the FREE TRIAL only once, regardless of the number of ACCOUNTS created, email addresses used, or payment methods added. Any attempt to obtain more than one free trial constitutes misuse under Article 11 of these Terms.
C - One-time purchases Some PRODUCTS are offered as one-time purchases, payable either in full or in installments. Permanent access to the PRODUCT is granted once payment has been made in full.
Article 4 - Non-Competition and Intellectual Property
By making a purchase on the Websites, the CUSTOMER represents that they do not conduct a professional activity that competes with the COMPANY's activities.
All PRODUCTS, content, methods, videos, audio recordings, text, images, and software offered on the Websites and on the “Learn French with Elisabeth” YouTube channel are the exclusive property of the COMPANY and are protected by the French Intellectual Property Code.
Any reproduction, distribution, resale, transfer, or use, in whole or in part and whether for personal or professional purposes, is strictly prohibited without the COMPANY's prior written authorization. The COMPANY may take legal action in response to any violation.
Article 5 - Placing an Order
Orders and subscriptions placed on the Websites are submitted and confirmed through an online order form.
Payments are processed by Stripe's secure payment platform. The COMPANY does not store the CUSTOMER's payment card details.
The CUSTOMER represents that they are the lawful holder of the payment method used.
All contractual information presented to the CUSTOMER is available in French and English.
Article 6 - Prices
All prices for PRODUCTS offered on the Websites include applicable taxes. Prices are displayed and charged in euros (EUR) or, depending on the CUSTOMER's location, in one of the currencies offered at checkout (USD, GBP, CHF, CAD, or AUD); the applicable currency is the one displayed at the time of the order or subscription.
The price in effect when the order or subscription is placed will apply. Prices for new orders may change at any time without prior notice.
For active SUBSCRIPTIONS, the CUSTOMER will be notified of any price change at least thirty (30) days before it takes effect. The CUSTOMER may cancel the SUBSCRIPTION if they do not accept the new price.
Article 7 - Performance and Delivery
A - Access to the online platform For digital PRODUCTS available through the platform, including online courses and subscriptions, access is granted immediately after payment is confirmed or the free trial begins. The CUSTOMER receives a confirmation email with access instructions.
B - Downloadable digital products Downloadable digital PRODUCTS, including PDFs and worksheets, are made available electronically within forty-eight (48) business hours after the order is placed.
C - Physical products Physical orders are delivered by mail. The COMPANY will ship orders within seventy-two (72) business hours after they are placed.
The COMPANY is not responsible for errors in the contact or delivery information entered by the CUSTOMER. If a product does not conform to the order, the CUSTOMER must submit a claim by email to contact@hellofrench.com no later than the third business day after receipt.
Article 8 - Right of Withdrawal
Under Articles L.221-18 et seq. of the French Consumer Code, the CUSTOMER has fifteen (15) days from confirmation of the order to exercise their right of withdrawal.
The CUSTOMER must first provide notice of any return by emailing contact@hellofrench.com or by sending registered mail to BEPITE SAS, 14 Rue Ernest Psichari, 75007 Paris, France.
Under Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for digital content not supplied on a physical medium when performance has begun with the consumer's prior express consent and express waiver of the right of withdrawal.
By accepting these Terms and accessing digital content, including courses, videos, or exercises, the CUSTOMER expressly waives the right of withdrawal with respect to digital content already accessed or used.
SUBSCRIPTIONS may be canceled at any time as provided in Article 3.
Article 8 bis - Personalized Services (Private Calls)
The annual SUBSCRIPTION to 360 French Immersion includes one private thirty-minute video call with a member of the teaching team (the “CALL”). The CALL is not included with the monthly SUBSCRIPTION or with one-time purchases of other PRODUCTS. The CALL is a personalized service within the meaning of Article L.221-28 of the French Consumer Code.
A - Waiver of the money-back guarantee The COMPANY offers a 15-day money-back guarantee for its digital PRODUCTS. However, by confirming a CALL booking, the CUSTOMER expressly acknowledges that the 15-day money-back guarantee will no longer apply to the order. Because the CALL is a personalized service delivered in real time, it cannot be canceled after it has taken place. Before booking, the CUSTOMER gives express consent by checking a box.
B - Installment payments If the CUSTOMER chooses to pay in installments, the CALL becomes available only after all installments have been paid in full. This condition is intended to ensure a mutual commitment by the parties.
C - Cancellation and no-shows The CUSTOMER may cancel or reschedule the CALL through the Cal.com booking platform up to twenty-four (24) hours before the scheduled time. If the CUSTOMER does not attend and has not canceled within that period, the CALL will be considered used and will not be rescheduled.
D - Availability The CALL is subject to availability. The COMPANY may suspend or withdraw this service for new orders at any time without affecting CALLS that have already been booked.
Article 9 - Service Availability and Changes
The COMPANY makes reasonable efforts to keep the platform available 24 hours a day, seven days a week, but does not guarantee uninterrupted access. Temporary interruptions may occur because of maintenance, updates, or force majeure.
The COMPANY may modify, expand, or remove platform content at any time without giving rise to any right to compensation.
Article 10 - Personal Data
The information requested from the CUSTOMER is necessary to process the order properly and provide the SERVICES.
Under the General Data Protection Regulation (GDPR) and the amended French Data Protection Act of January 6, 1978, the CUSTOMER has the right to access, correct, delete, and obtain a copy of their personal data, and to object to its processing.

For more information about how personal data is processed, the CUSTOMER should review the Privacy Policy available on the Websites.
Article 11 - Misuse and Fraud
The COMPANY uses technical measures to prevent misuse of its SERVICES, including the creation of multiple accounts, attempts to bypass free-trial limits, and fraud.
If the COMPANY detects conduct that violates these Terms, it may, without prior notice or compensation:
- Suspend or delete the CUSTOMER's ACCOUNT - Cancel any active SUBSCRIPTION or free trial - Refuse any new order or subscription - Require payment of any outstanding amounts
The COMPANY is not required to explain its decision or disclose the detection methods used.
The CUSTOMER acknowledges that fraud-prevention measures may occasionally affect legitimate use. If the CUSTOMER experiences technical difficulties accessing a SERVICE, they should contact contact@hellofrench.com.
Article 12 - Liability
The COMPANY will not be liable for loss or damage arising from the use of, or inability to use, the PRODUCTS and SERVICES, including in cases of force majeure, outages, maintenance, or technical malfunction.
The COMPANY's liability is limited to the amount the CUSTOMER paid for the PRODUCT or SERVICE concerned.
Article 13 - Governing Law and Disputes
These Terms are governed by French law.
In the event of a dispute, the CUSTOMER may seek an amicable resolution through mediation within twelve (12) months. The CUSTOMER may refer the matter to the appropriate consumer mediator free of charge.
If the dispute cannot be resolved amicably, the courts with jurisdiction in Paris will have exclusive jurisdiction.
